Terms of Service.

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of Onsight – Bouldering, later “Onsight”, a mobile coaching tool for boulder climbers published by KOSHINA APPS (“Koshina Apps”, “we”, “us”, “our”). By installing or using Onsight, you agree to these Terms. If you do not agree, do not use the app.

These Terms are a binding agreement between you and Koshina Apps.

2. The Service

Onsight lets you record or import short videos of climbing attempts and receive AI-generated movement feedback. Feedback is generated by Anthropic’s Claude model based on the video frames and any context you provide. You can chat with the AI about specific clips or about a project (a problem you are working on across multiple attempts).

Onsight is a coaching aid. It is not a substitute for a qualified human coach, training partner, or medical professional.

3. Eligibility

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use Onsight. By using the app you represent that you meet this requirement.

4. Your Content

“Your Content” means video clips, text context, chat messages, project metadata, and any other material you provide to Onsight.

You retain all rights to Your Content. By using the app, you grant us a limited, non-exclusive, worldwide license to process Your Content solely as necessary to provide the service — meaning, transmitting it to Anthropic for analysis, storing it locally on your device, and displaying it back to you. We do not use Your Content to train AI models, and we do not share Your Content with third parties beyond what is described in our Privacy Policy.

Your Content is stored locally on your device. Uninstalling the app removes local data, although iCloud Backup (iOS) or Google Backup (Android) may persist app data beyond uninstall if you have those services enabled. This is a platform behavior outside our control. You are responsible for backing up or exporting Your Content if you wish to preserve it.

5. Acceptable Use

You agree not to:

• Use Onsight for any unlawful purpose or in violation of any applicable law.
• Submit content that is illegal, harmful, harassing, defamatory, or violates the rights of others.
• Attempt to reverse-engineer, decompile, or extract the source code of the app, except as permitted by law.
• Attempt to bypass usage limits, subscription entitlements, or the Cloudflare proxy that routes API requests.
• Use Onsight to send abusive, spam, or excessive automated requests to our infrastructure or to Anthropic’s API.
• Misrepresent yourself, impersonate others, or use the app on behalf of someone without their consent.

We may suspend or terminate your access if you violate these rules.

6. Subscriptions and Payment

Onsight offers an optional paid tier, Onsight Plus, with higher monthly limits on analyses and chat messages. Subscriptions are sold through Apple’s App Store and Google Play and are billed by them, not by us.

Pricing, billing intervals (monthly or yearly), automatic renewal, free trials (if any), and refund policies are governed by Apple’s and Google’s standard subscription terms. You manage, cancel, or change your subscription through your App Store or Google Play account settings.

If your subscription lapses or is canceled, your account reverts to the free tier and the corresponding usage limits apply. Your existing clips, projects, and chat history remain on your device.

7. Free Tier and Usage Limits

Onsight includes a free tier with limited monthly analyses and chat messages. Limits reset each calendar month. Exceeding free-tier limits requires an active Onsight Plus subscription. Limits may change over time as we tune the service; material changes will be reflected by updating these Terms.

Failed analyses (e.g., network errors) do not consume your quota where we can detect the failure. We make a best effort to track usage accurately but cannot guarantee perfect accounting. If you believe your usage has been miscounted, contact us.

8. AI-Generated Output

Movement feedback and chat responses are generated by an AI model. AI output can be inaccurate, incomplete, or wrong. The model can sometimes assert specific details about holds, body positioning, or movements that did not actually occur in the clip. You should treat AI feedback as a starting point for thinking about your climbing, not as authoritative coaching advice.

We do not guarantee that AI output is correct, suitable for your skill level, or safe to act on. Climbing involves inherent physical risk. You are solely responsible for your decisions about how, what, and whether to climb. Do not attempt movements you are not physically prepared for. If you have an injury, medical condition, or doubts about your safety, consult a qualified human professional.

9. Intellectual Property

The Onsight app, including its design, code, prompts, and branding, is owned by Koshina Apps and protected by copyright and other intellectual property laws. We grant you a limited, non-transferable, revocable license to use Onsight on your personal devices for non-commercial purposes, subject to these Terms.

The “Onsight” name and logo are trademarks of Koshina Apps. You may not use them without our written permission.

10. Third-Party Services

Onsight relies on third-party services including Anthropic (AI processing), Cloudflare (proxy infrastructure), RevenueCat (subscription management), and Apple/Google (app distribution and billing). Your use of Onsight is also subject to the terms of these providers where applicable. We are not responsible for the acts or omissions of third-party providers.

11. Disclaimers

Onsight is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We disclaim all warranties including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted operation.

We do not warrant that the app will be error-free, that AI feedback will be accurate, that the service will always be available, or that any defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by law, Koshina Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or related to your use of Onsight, whether based on contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims arising from or related to Onsight shall not exceed the greater of (a) the amount you paid us for the service in the twelve months preceding the claim, or (b) USD $50.

Some jurisdictions do not allow limitation of liability for certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable consumer protection law, including liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded or limited by law.

13. Indemnification

You agree to indemnify and hold harmless Koshina Apps, its affiliates, and personnel from any claim, demand, loss, or expense (including reasonable legal fees) arising from (a) your violation of these Terms, (b) your misuse of Onsight, or (c) Your Content infringing the rights of any third party.

14. Termination

You may stop using Onsight at any time by uninstalling the app. We may suspend or terminate your access to Onsight at any time, with or without cause, including for violation of these Terms or where required by law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) survive.

15. Governing Law

These Terms are governed by the laws of the Republic of Armenia, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of Onsight shall be brought in the courts of Yerevan, Armenia, and you consent to the jurisdiction of those courts.

If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection laws, this clause does not deprive you of the protection of mandatory provisions of the law of your country of residence.

16. Changes to These Terms

We may update these Terms as the app evolves or as required by law. Material changes will be reflected by updating the Effective Date at the top. Continued use of Onsight after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, stop using the app.
